Terms of Service
These Terms of Service ("Terms") govern your use of Vin-G and all its products (collectively, "the Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Vin-G provides a suite of business management tools including analytics, appointment scheduling, authentication, email campaigns, CRM, document storage, expense tracking, form building, HR management, invoice generation, e-commerce store building, website generation, and job portal services.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must promptly notify us of any unauthorised access to your account at security@vin-g.com.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Send spam, phishing messages, or unsolicited commercial communications
- Infringe the intellectual property rights of others
- Upload malware, viruses, or malicious code
- Harass, abuse, or harm any person
- Attempt to gain unauthorised access to any system or data
- Circumvent any security or rate-limiting mechanism
- Use the Service to build a competing product without our written consent
- Collect or harvest data from other users without consent
5. Intellectual Property
5.1 Your Content
You retain full ownership of all content you create, upload, or store using the Service ("Your Content"). By using the Service, you grant Vin-G a limited, non-exclusive, royalty-free licence to host, store, copy, and display Your Content solely to provide the Service to you. We claim no ownership over Your Content and will not use it for any other purpose.
5.2 Our Platform
Vin-G owns all rights in the Service, including its software, design, trademarks, and documentation. These Terms do not grant you any rights in the Vin-G platform except the limited right to use it as permitted here.
5.3 Feedback
If you provide feedback or suggestions about the Service, you grant us a perpetual, royalty-free licence to use that feedback without obligation to you.
6. Payment and Billing
If you subscribe to a paid plan, you agree to pay all applicable fees. Fees are non-refundable except as required by applicable law or as stated in our refund policy. We may change pricing with 30 days' notice. Payment is processed by Stripe; see their terms for payment processing terms.
7. Data and Privacy
Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS WILL BE CORRECTED.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIN-G'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO VIN-G IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS (USD $100).
IN NO EVENT WILL VIN-G BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10. Indemnification
You agree to indemnify, defend, and hold harmless Vin-G and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any third-party rights.
11. DMCA and Copyright
We respect intellectual property rights. If you believe content on the Service infringes your copyright, see our DMCA Policy for how to submit a takedown notice.
12. Termination
Either party may terminate your account at any time. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to use the Service ceases. You may export your data within 30 days of termination. After 30 days, we will delete your account data in accordance with our Data Retention Schedule.
13. Modifications to the Service
We may modify, suspend, or discontinue the Service or any feature at any time. We will provide reasonable notice of material changes. Your continued use of the Service after changes take effect constitutes acceptance of the changes.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. EU residents retain the right to bring disputes before the courts of their member state and to benefit from mandatory EU consumer protections. US residents may bring claims in small claims court for qualifying disputes.
15. General
- Entire agreement: These Terms (plus our Privacy Policy and any product-specific addenda) constitute the entire agreement between you and Vin-G regarding the Service.
- Severability: If any provision is held unenforceable, the remaining provisions remain in force.
- No waiver: Our failure to enforce any right does not waive our right to enforce it in the future.
- Assignment: You may not assign these Terms without our written consent. We may assign them in connection with a merger or acquisition.
